Sponsored
This visa option allows migrants with certain skills and expertise in certain occupations
who are sponsored by either an eligible relative or sponsorship participating
state or territory, to migrate with members of their immediate family to
Australia on a permanent visa. Migrants on this visa are restricted to live and
work in certain states or territories for at least 2 years.

territory in Australia to
permanently live and work in Australia.
Applicants would need to demonstrate they have competent English and a
successful skill assessment before they can be granted the sponsorship to apply
for the visa.
The following are the standard
requirements for this visa:
• over 18 and under 50 years of age
• have the skills and qualifications that meet the Australian standard for an occupation on the Skilled Occupation List
(SOL)
• you have a nomination from a participating State or Territory government
agency.

SKILLED SPONSORED (REGIONAL)

This Visa is a three year provisional visa for skilled workers who can not
obtain the point required for Skilled - Independent visa. This visa is a pathway
to permanent residence. Applicants can be able to apply for permanent residence
provided they reside in certain regional areas for two years and work there for
at least a year.
Applicants and members of their immediate family would have to abide by the
residence requirement to qualify for permanent residence.
The definition of Specified
Regional Area depends on whether you are being sponsored by an eligible
relative or nominated by a State or Territory government.
You maybe eligible for this visa if you are:

• a New
Zealand citizen who holds a Special Category

Temporary Business (Long Stay) - Standard Business Sponsorship (Subclass
457)
This program allows Australia Employers
to sponsor their employees or prospective employees with certain skills to Australia on a
temporary visa. Sponsored employees are obliged to work for their sponsor
during the sponsorship period. This is a pathway to permanent residence.
Employees can be sponsored by their employers for a permanent visa after two
years of working for their sponsor.
Employers can be either:
• Australian businesses
• overseas businesses.
Employer can employ overseas workers for a period of between three (3)
months and four (4) years. As an Employee of this subclass of visa you can:
• work in Australia
for a period of between three (3) months and four (4) years

There are a number of obligations that employers are required to meet. These

to return them to their home country
• pay all medical or hospital expenses for an employee (and accompanying family member) for

FAMILY MIGRATION

The family stream of Australia's
Migration Program provides an opportunity for Australian citizens, Australian
permanent resident and Eligible New Zealand citizens to reunite in Australia with
their close family members eg. spouse, fiancé(e)s interdependent partners,
dependent children and adopted children. Others include other family members
such as parents, orphan relatives, carers, aged dependent relatives, and
remaining relatives.
Aged dependent relative
An aged dependent relative is a person who is old enough to be granted an
Australian age pension, who is single and remains dependent on an Australian
relative. Qualifying age for men is 65 while for women the age is gradually
being increased from 60 to 65.
The sponsoring relative in Australia
must be a child, adopted child, parent, brother or sister, grandchild, uncle or
aunt, niece or nephew (or step-relative equivalent) of the applicant.
Sponsored Aged dependent relative must prove that they are wholly or
substantially dependent on the sponsoring Australian relative for financial
support for their basic necessities. They must be supported by the sponsor over
a reasonable period (normally three years).
Remaining relative
A remaining relative is a person who has no close family ties outside Australia and is the brother, sister, child or
step equivalent of an Australian citizen, Australian permanent resident or
eligible New Zealand
citizen.
The applicant and spouse (if any) must not have any close relatives in any
country apart from Australia.
A near relative is a parent, sibling, non-dependent child or their step
equivalent.
A person who has previously been granted a Subclass 104 (Preferential Family)
visa, Subclass 115 (Remaining Relative) visa, Subclass 806 (Family) visa or
Subclass 835 (Remaining Relative) visa cannot sponsor an applicant for a
remaining relative visa. A person who has previously sponsored a successful
applicant for a Subclass 104 (Preferential Family) visa, Subclass 115
(Remaining Relative) visa, Subclass 806 (Family) visa or Subclass 835
(Remaining Relative) visa cannot sponsor another person for a Remaining
Relative visa.
Carer
A carer is a person willing and able to give substantial, continuing and direct
assistance to an Australian relative (or member of their family unit) who has a
medical condition that impairs their ability to attend to the practical aspects
of daily life.
An Australian relative may be the spouse of the person, or child, adopted
child, parent, brother or sister, grandparent, grandchild, aunt or uncle, niece
or nephew or step equivalent.
The need for assistance must be likely to continue for at least two years.
An assessment of the Australian
relative's medical condition must be made by Health Services Australia (HSA).
Evidence that the Australian relative has arranged a medical examination with
HSA must be provided with the application.
Sponsorship: All applicants in the Other Family category, whether
they apply within or outside Australia,
must be sponsored. The sponsor must be either an Australian citizen, Australian
permanent resident or eligible New
Zealand citizen, and would usually be 18
years of age or older.

SPOUSE/FIANCEE VISA

Partner Visa
Partners of Australian citizens, permanent residents or eligible New Zealand
citizens are required to apply and be assessed against the laid down criteria
for the grant of a partner visa.
Australia Partner Visa scheme has three categories for partners of Australian
citizens, permanent residents or eligible New
Zealand citizens wishing to migrate to Australia.
Australia's Partner migration programme permits for the subsequent grant of a
visa that permits spouses, de facto partners and interdependent partners
(including those in a same-sex relationship) to enter and remain permanently in
Australia.
Fiancée Visa (Australian Prospective Marriage Visa)
Applicants must be living outside Australia and be engaged to be married to an
Australian citizen, permanent resident or eligible NZ citizen, and wish to
marry that person in Australia. This means applicants cannot apply for a
fiancée visa if you are in Australia.
Applicants must be able to demonstrate to the Department that they have genuine
intentions to marry their fiancée, be committed and be prepared to live
together as spouses.
Applicants are also assessed on
their character and public health. In addition, an assurance of support may be
required if there is a dependent child or children included the application.
Spouse Visa (Australian Spouse Visa)
Applicants must be in a married or a de facto relationship with an Australian
citizen, Australian permanent resident or eligible NZ citizen. They can apply for
this visa in or outside Australia.
If they are living overseas and are engaged to be married to an Australian
citizen, permanent resident or eligible NZ citizen, and intend to marry their
spouse before entering Australia,
they can apply for a spouse visa but they must marry their spouse before a
spouse visa can be granted.
They must be able to prove to the Department that their relationship is genuine
and sustainable.
With the exception of a couple who
can establish that they have been in a long term spousal relationship applicants
must first obtain a provisional visa granting temporary residence. They may be
granted permanent resident after two years depending on whether they are able
to meet further criteria of the Department.
Interdependent Partner (Australian Interdependent Visa)
To be eligible for this visa applicants must be in an interdependent
relationship with an Australian citizen, permanent resident or eligible NZ
citizen . Interdependent relationships include same sex couples.
Applicants can apply for this visa either in or out of Australia. Applicant
need to prove to the department that the relationship is genuine and likely to
be sustainable.

CHILD

These parents need to be sponsored by
their children. There are two types of visas for parents wishing to migrate to Australia:

Both parents visas have similar visa requirements. The major difference is applicants
for the Contributory Parent visa must make a significant contribution to their
future health and welfare costs. The Contributory Parent visa category is a 2
year temporary visa.
Temporary Contributory Parent visas holder can apply for a permanent
Contributory Parent visa after living in Australia for a while. Both parent
visas are capped however there is a higher number of places for Contributory
Parent Visa applicants than Parent Visa applicants. It also has a higher processing
priority than parent visa.
Other requirements are Public Interest Criteria: (Health and Character (Police Clearance)). An Assurance of Support and bond must be provided.
What is Balance of Family Test
The number of children of the parent who are lawfully and permanently resident
in Australia or are eligible New Zealand citizens usually resident in Australia
is:
(i) greater than, or equal to, the total number of children of the parent who
are resident overseas; or
(ii) greater than the greatest number of children of the parent who are
resident in any single overseas country.
Aged parents:
for men the qualifying age is 65 years.

STUDENT

This visa permits applicants to temporarily study and work in Australia.
Applicants need to meet certain conditions before they are granted this visa. Holders
of this visa must abide by certain conditions on their visa. Failure to abide
by the conditions may lead to a cancellation of the visa and subsequent removal

There are seven sub-classes for each education sector.
Student visa sub-classes
Subclass 570 - Independent ELICOS
This visa is for international students undertaking ELICOS (English Language
Intensive Courses for Overseas Students) as a stand-alone course, and not as a
prerequisite to commencing another course (for example, a degree course)
Subclass 571 - Schools
This visa is for international students undertaking a course of study at a
primary school or a secondary school, including both junior and senior
secondary school, and an approved secondary exchange program
Subclass 572 - Vocational and technical education (VTE) sector
This visa is for Certificate I, II, III and IV, Diploma and Advanced Diploma.
Subclass 573 - Higher education
This visa is for a Master degree by course work, Bachelor degree, Associate
Degree, Graduate Certificate, and Graduate Diploma
Subclass 574 - Postgraduate Research
This visa is for a Masters degree by research and a Doctoral degree
Subclass 575 - Non-award
This visa is for foundation, bridging or other courses that do not lead to the
award of a degree, diploma or other formal award
Subclass 576 - AusAID or Defence sponsored
This visa is for full-time study undertaken by AusAID or Defence students
sponsored by the Australian Government.
General requirements for visa Applicants
• Applicants must be of good character
• Applicants must have sound health
• Applicants must have acceptable health insurance
through the Overseas Student Health Cover (OSHC) for yourself and members of your
family unit accompanying you to Australia
• Applicants must have no outstanding debts to the
Commonwealth of Australia, or have made arrangements acceptable to the Minister
to repay such a debt
• where you are under 18 years of age, acceptable
arrangements for your accommodation, support and general welfare are in place

valid enrolment for your course
• visa holders must not work unless
you have been granted permission to do so
• visa holders must maintain your Overseas Student Health (OSHC) cover while in

address within seven days of your arrival in Australia. They must also advise them
of any subsequent change in their address within seven days.
Offer of a place in a course and confirmation of enrolment
Visa application lodged outside Australia
and assessed at either Assessment Level 2, 3, 4 or 5, are required to provide:
• an ‘offer of a place in a course’
letter from your Australian education provider at the time of lodging their
application and
• an electronic confirmation of enrolment certificate issued by your education
provider after lodging their application if they are requested by the
Australian overseas mission to do so.

Assessment levels for student visas
Student visa applications are assessed by assessment levels. Assessment levels
are determined by nationality of applicants.
The assessment levels depend on the likelihood of applicants abiding by their visa
conditions. This is done by examining previous students’ behaviour. Assessment
level 1 represents the lowest assessment level and assessment level 5 the
highest.
Applicants with higher assessment levels are required to provide financial
capacity and to demonstrate they have a adequate understanding of the English
language. They may be required to provide some other evidence in addition the
afore mentioned.

duration of their stay in Australia
